MyChart: Terms and Conditions of Use ("Agreement")

 

MyChart is a secure internet and mobile communications and information service which Driscoll Children’s Hospital and it affiliated entities, clinics and healthcare providers (collectively “Driscoll”) is offering at no cost for the convenience of our patients. MyChart allows electronic access to portions of clinical and financial records of a patient, as well as online communication functions to facilitate your interactions with Driscoll. Use of MyChart is voluntary and you are not required to use MyChart to receive treatment at Driscoll.

 

PLEASE READ THE FOLLOWING INFORMATION CAREFULLY.  THESE TERMS & CONDITIONS OUTLINE YOUR RESPONSIBILITIES WHEN USING MYCHART.  BY USING MYCHART YOU ARE AGREEING TO THESE TERMS & CONDITIONS AND THAT YOU ACCEPT THE RISKS AND TERMS OUTLINED BELOW. IF YOU DO NOT AGREE TO THESE TERMS PLEASE EXIT THIS SITE.

 

Driscoll reserves the right to make changes to these Terms & Conditions at any time and for any reason. When you use MyChart you agree to all terms and conditions which are in effect on the date that you access and use MyChart.

 

Immediate Medical Needs and Emergency Care:  MyChart is not designed to be used for immediate medical needs or in an emergency. If you or the person for whom you are a proxy experiences a medical problem and you are uncertain of its severity, you should call your healthcare provider, go to the nearest hospital emergency room, or call 9-1-1 for assistance. MyChart is not a substitute for a visit with a healthcare professional.

 

MyChart Enrollment Eligibility:

You are eligible for enrollment in MyChart if you meet all of the following eligibility criteria:

  • you are a registered patient with Driscoll or the proxy for a registered patient of Driscoll;
  • you are at least 13 years of age or have had the disabilities of minority legally removed;
  • you maintain full compliance with your MyChart obligations;
  • you meet other Driscoll eligibility criteria that Driscoll may establish at its sole and reasonable discretion.

 

MyChart is intended as a secure online source of confidential medical information. You must have internet access and a computer internet browser capable of accessing MyChart.

 

Minor Eligibility:

Parents or guardians of minor children, age 0 to 17 may request proxy access to their child's account by following the terms outlined in the proxy access section below. When a minor patient reaches age 18, his/her parent or guardian’s MyChart proxy account shall be terminated. The minor will be eligible for his/her own unrestricted account when he/she reaches age 18.

 

A parent/guardian may withhold permission to allow the child access to their MyChart account. A form will be available for parent/guardian signature to opt out of MyChart access for the child.

 

Proxy access:

Proxy access allows you access to the MyChart account of someone other than yourself. You may request proxy access if you are:

  • the parent or legal guardian of a minor child under the age of 18; or
  • a legally appointed guardian or healthcare decision maker for a patient over the age of 18; or
  • granted access by a patient over the age of 18.

 

Driscoll reserves the sole right to determine whether proxy eligibility exists and to whom it will grant proxy access rights. If you have proxy access and your legal right to obtain proxy access for the patient changes, you must notify Driscoll immediately of that change and must not access that patient’s MyChart account at any time after your legal proxy access rights have expired or been terminated. Any attempt to access information you are not entitled to receive is a breach of these Terms & Conditions, and Driscoll reserves the right to revoke or suspend your access to MyChart, refer the violation to the appropriate authorities and to take any appropriate legal action.  By entering MyChart under minor proxy access you are certifying that you are the parent or legal guardian of the patient.

 

There are certain types of medical information that a parent or legal guardian of a minor may be restricted from viewing under various state and federal laws and proxy access to this medical information may be denied.

 

Username and Password ProtectionYour username and password provide access to your personal records or the records of the patient for whom you are a proxy. It is your responsibility to select a confidential password, to maintain my password in a secure manner, and to change the password if you believe it may have been compromised in any way. You should not share this information with anyone else. If you share your MyChart ID and password with another person, that person may be able to view your health information and information about someone who has authorized you as a MyChart proxy. You agree not to hold Driscoll liable for any loss, injury or claims of any kind resulting from your disclosure of the confidential password or confidential information on MyChart.

 

Electronic Communications: As a MyChart participant you may receive electronic notices to the e-mail address you used to register in MyChart. You are responsible for keeping your email address current. These notices will let you know when new information is in your MyChart account. Any person with access to the e-mail account used to set up MyChart will be able to see this notification. It is your responsibility to monitor the messages in your MyChart inbox. Additionally, Driscoll's healthcare providers are only able to respond to communications that you send through the MyChart based on the information you provide. If you do not provide enough information, your healthcare providers may not be able to provide an accurate response. You agree that you will not hold Driscoll liable for any loss, injury, or claims of any kind resulting from use of MyChart that you do not read in a timely manner or that are in response to insufficient or inaccurate information provided by you. MyChart communications are part of the patient’s official medical record and other healthcare providers may read the communications. The posting of medical information to MyChart is at the discretion of the patient’s individual healthcare provider(s). Not all healthcare providers at Driscoll choose to communicate with patients or their proxies via MyChart.

 

System UnavailabilityMyChart may become unavailable from time to time. Access is provided on an "as-is, as-available" basis and does not guarantee that you will be able to access MyChart at any particular time. Alternate means for communicating with Driscoll includes communication by phone, mail, or personal visit to a Driscoll office.

 

Termination of accessAccess to MyChart is provided as a convenience and Driscoll has the right to deactivate, restrict or terminate access to MyChart at any time for any reason or no reason without notice to you.

 

Privacy:

We afford the same degree of confidentiality to medical information stored on MyChart as is given to information stored in any other medium. Firewalls, passwords, encryption, and audit trails are some of the safeguards used to safeguard our patients’ information. Please refer to the Notice of Privacy Practices for detailed information about Driscoll’s use or disclosure of protected health information to provide medical treatment, to collect payment for services provided, and to facilitate Driscoll’s healthcare operations.

 

Information Accuracy: Driscoll will engage in commercially reasonable efforts to accurately collect, store and display through MyChart data that is collected from or about you, the patient, or the proxy in the course of your relationship with Driscoll. Driscoll will also make reasonable efforts to correct erroneous data on file when notified of the error. Driscoll does not and cannot guarantee that all information collected from or about you, the patient, or the proxy in the course of your relationship with Driscoll is true and correct, and by accepting these Terms & Conditions you acknowledge and accept that errors related to your personal data may occur.

DRISCOLL TAKES NO RESPONSIBILITY FOR AND DISCLAIMS ANY AND ALL LIABILITY ARISING FROM ANY SOFTWARE INACCURACIES OR SOFTWARE DEFECTS, COMMUNICATION LINES, VIRTUAL PRIVATE NETWORK, THE INTERNET OR INTERNET SERVICE PROVIDER (ISP), ACCESS SYSTEM, COMPUTER HARDWARE OR SOFTWARE, OR ANY OTHER SERVICE OR DEVICE THAT YOU USE TO ACCESS MYCHART.

By registering for Driscoll MyChart, you acknowledge that you have read and fully understand the information provided in this form. You understand the risks associated with using electronic systems to contact and receive information from Driscoll.
